James Sturgis wrote his will on Mar 22 1828 and it was proven in Worcester Co., MD on Apr 10 1828:
- To wife Sarah the farm on which I now live until son George H. Sturgis reaches age 21 when he gets the land and she to get her dower part
- To son John Raymon Sturgis, 50a of tract called "Friends Assistance" and 28.5a of "Addition To The Hammer" adjoining land I hold bond of converyance with Hugh Nelson's heirs
- Negroes George, Amelia and her son Zadok to be sold to pay my debts
- To wife Sarah, negro man Littleton, my mare/carriage and bed/furniture
- To John Mills Nelson in trust for my daughter Mary Brittingham, negro boy Robert for her exclusive benfit and that her husband have no control over him
- To son Joshua Hitch Sturgis, negro boy Benjamin
- To son David James Sturgis, negro girl Maria and if she has issue before my death then it to go equally between daughters Sally & Elizabeth & said son David James
- To sons George Henry Sturgis and John Rayman Sturgis, negro boy Levi
- To daughter Matilda Grace Nelson, negro girl Leah
- To daughter Sally Brattan Sturgis, negro boy Lemuel
- To daughter Elizabeth Catherine Sturgis, negro woman Dosha
- To wife Sarah to be executrix

James next married Sarah (Sally) Hitch, daughter of Joshua A. Hitch and Mary (Molly) Taylor, on 28 Dec 1819 in Worcester Co., MD.¹ (Sarah (Sally) Hitch was born about 1777 in Somerset Co., MD and died after 1830 in Worcester Co., MD.)
