His gravestone still exists in 2024 as Michael Stuart Senior, and states he died May 17 1812 at age 39-3-15 (born Feb 2 1773)
Michael Stuart had land called STUARTS PURCHASE surveyed for him in Sussex on Feb 15 1802 for 200 acres just north of modern Concord, DE. It was on an Oct 9 1793 warrant, Bevans Turner (and as Beavens), for vacant and in part cultivated land in Nanticoke 100 adjoining his other land. He lately sold/assigned the same lands to Michael Stuart who had surveyed the land lying in and adjoining the plantation of said Stewart and on main road leading from the Village of Concord on Deep Creek to Georgetown and near the said creek.
Michael Stuart is proven as brother to Peter Stuart, who is father of Captain John M, Stuart, from a Delaware land record dated Aug 5 1812 where Peter Stuart received a deed a lot of ground in the village of Concord, DE from Thomas Laws and Michael's actual will. This lot was described as one that Michael Stuart had paid for to Laws but had died before a deed was conveyed. Michael Stuart's will devised the lot of ground to Peter and the land transaction was recorded on Aug 5 1812. Michael Stuart had purchased this land on Apr 28 1800 where it describes in the records that Michael Stuart purchased a lot of ground where he "now lives" on Deep Creek in Broad Creek Hundred, from Thomas Laws and Mila his wife for $60 (SxLR).
On Jul 26 1810, Michael Stuart purchased from Levin Stuart and his wife, Hester, all of Sussex Co., for $90, Lots 22, 23, 24 in Concord, DE (SxLR). On Nov 9 1811, Michael Stuart purchased from Seth Griffith and his wife, Nancy, all of Broad Creek Hundred, for 58 pounds, 68.75a part of tract "Nanticoke" and 3a adjacent in Nanticoke Hundred. (SxLR).
When Michael Stuart wrote his will, he leaves everything to his wife, siblings and nephews suggesting he has no children as heirs. He wrote his will on Apr 13 1812 and it was proven in Sussex Co., DE on May 28 1812 with the following provisions: - Wife Elizabeth as executrix - To brother William Stuart, 200a of land beginning at Peg (Pig) Landing on the Nanticoke River running out with Clear Brook towards Deep Creek until a direct line to the Nanticoke makes out the amount of land mentioned. (Note: this seems to be his STUARTS PURCHASE tract) - To nephews Joseph Huffington and Daniel Hall, $200 each - To brother Peter, all that lot I bought of Thomas Laws including the Store House and other buildings - To nephew Daniel Stuart, $300, to be paid to him at age, if he were to die before then, then the money to go to Mary Stuart's two daughters when they reach age eighteen. - To Mary Stuart, $50 and no more, to be paid to her in one year - To my beloved wife, my plantation where William Stuart now lives with 400a of land inclusive to be laid off adjoining the same be laid off for William Stuart. Also to my wife, the house and lot I now live to her and her heirs forever. I also give her my carriage and choice of horses and half of my personal estate after debts are paid. - To nephew Michael Stuart all the remainder of my estate and if he should die before receipt, William Stuart's son James to get this. - Negro Jack to be free after Christmas next - Negro Sam to be free after Dec 25 1816 - Negroes Beck and her two children Lewes and Moriah free after they reach the age of 30 each.
