John Hardy's will was written on Feb 10 1748/49 and proven on Mar 13 1748/49 in Somerset Co., MD as follows:
- To son Joseph Hardy, 65a of land with my dwelling plantation
- To son Benjamin Hardy, all remainder of my lands
- To son Joseph, a cow/yearling and two year old heifer and my gun
- To son Benjamin, same except four year old heifer
- To daughter Phillis Hardy, a three year old heifer now with calf and yearling
- To my three children under the care of Joseph Callaway and two sons to be free at age of 18 - divid rest of estate equally between the three children
- Appoint Joseph Callaway executor
Witnesses: John Lankford Jr., Willima Carter, Robert Twilley (SoW-EB14:13)

Note - the "lands" here are noted as John Hardy's portion of the 500a tract "Orphans Lot", he inherited from his father - it is located in the modern day at the extreme SW corner of the State of Delaware in Sussex County. John Hardy owned ~148a of which 65a is bequeathed to son Joseph and the remainder to son Benjamin.
