Then came: on the 26th of April 1784 William Molleston, Richard Basset and Edward Tilghman, Esq. of the Town of Dover and severally did depose that on the 25th day of April 1784 in the forenoon of the said day Jacob Moore, Esq., deceased being on his death bed about -- hours before he died the said Edward mentioned to him the propriety of making his will and that as soon as reasonably might be which the said Richard also recommended to the said Jacob--that the said Jacob agreed thereto saying it might easily be done as he gave all he had to his wife and the said Richard and Edward well remembered that she should be his executrix-but the said William does not recollect this--that the said Edward then asked Jacob whether the said Richard and Edward should prepare a will for him to execute and he directed them so to do and after some further conversation agreed that provision should be made therein with regards to a certain confiscated property the said Jacob had purchased and that during all that passed between them he the said Jacob was of perfect sense and disposing mind and that the said Richard and Edward immediately consulted together respecting the form of the said will and it was agreed that Richard should draw the same. And the said Richard further saith that he immediately drew the pater writing marked A and showed the same to Jacob who approved of the same, except the part thereof respecting the confiscated property which he said upon consideration was unnecessary that when the said Jacob approved thereof as aforesaid he was of perfect sound and disposing memory and understanding--that the said Richard in consequence of the said Jacob's directive drew the paper writing marked B but the said Jacob by the time he finished the same was in such a situation as to be in his opinion incapable of executing the same and the said deponents further state that the wills are exactly according to his directions
