Mary Clarke
A court case on Jan 2 1654 in Northampton Co., VA refers to Mary (Clarke) Hammond: Upon the petition of Mary, the wife of Rich. Jacobs, it appears that her son Edward Hammond is greatly damnified (by a survey lately taken upon the land appertaining unto the said orphan, by Mr. Wm. Mellinge) which land extends to the full quantity of 250 acres, situated and abutting upon the land (lately belonging unto Mr. John Rogers dec'd) upon the broad creek which was formerly surveyed by Mr. Edm. Scarburgh, beginning at the ancient great marked pine tree and running in breath westerly towards the land of Rich. Jacob, northerly upon the main branch, and southerly unto the woods. Its therefore thought fit and ordered that the said tract of 250 acres be survey within 30 days after the date here of (according to the instructions above expressed) that the instructions and full quantity of land appertaining unto the said Edward Hammond, orphan, may be exactly laid out in length and breath (as in justice and equity the same ought to be). Recorded 4 Feb 1653/54. (NOTE: According to Whitelaw, p. 379, tract N66, in 1642 Edmund Scarburgh reported a survey of 300 acres which he had made at the request of Roger Johns. It was on both sides of the later county division line (Occahannock Cr). In 1645 a patent for 250 acres of the same land on Occahannock Cr went to Roger Johns which was repatented by Edward Hammond in 1654, as son-and-heir of Mark Hamond. Therefore, on 2 Jan 1653/54 when Mary, the widow of Mark Hammond who had married Richard Jacob, mentioned that this land was abutting the land lately belonging to Mr. John Rogers dec'd, she was refering to Roger Johns, not John Rogers. Or this was a transcription error by either the clerk of court in 1653/54 or by Frank Walczyk about the year 2000.) Mary married Mark Hammond. (Mark Hammond was born about 1615 in England and died before 12 Jan 1652 in Northampton Co., VA.) Mary next married Arthur Upshur. (Arthur Upshur was born in 1624 in Essex, England, died on 26 Jan 1709 in Accomack Co., VA and was buried about 29 Jan 1709 in Warwick, Quinby, Accomack Co., VA.) |
