- To daughter Susanna Sophia Heard, negro girl Maria.
- To son James F4rancis Abell Heard, negro Edward
- To son Robert Abell Heard, negro boy Washington
- My personal and real estate shall not be divided until my youngest son Robert Abell Heard arrives at age 18 - to be kept together as if I was living
- To second son James Elias Heard, after son Robert reaches age 18, to take or buy my home and plantation known as "Hanovers Addition" containing 150a of land at $2.00/acre and he to have ten years credit to pay for it
- To my eight children Henry James Heard, James Elias Heard, James William Heard, James Walter Heard, James Marcellus Heard, Susanna Sophia Heard, James Francis Abell Heard, and Robert Abell Heard after the time before named and after wife's thirds and legacies already mentioned, to equally divide the remainder of my estate.
- If my son Henry James Heard marries a young lady named Matilda Norris, the daughter of the late Joseph Norris, that he shall inherit no part or benefits of my estate more than one shilling or 13 1/3 cents.
- Appoint wife Sophia N. Heard and son James Elias Heard as executors.
