This compiler's original theory on Jacob Elliott's parentage: Jacob Elliotts' father seems to be one of three possibilities: Jacob Sr. (1740/50-aft 1830), Joshua (1765/74-??) or Samuel (1755/65-1820/30)...Given Joshua's age, it would seem to eliminate him as well, leaving Samuel or Jacob Elliott Sr. This Jacob names sons both Jacob and Samuel. My original thesis proved RIGHT for, on Sep 11 2009, I proved the father of Jacob Elliott to be Samuel Elliott - see notes under the listing for the latter.

Jacob Elliott is established as father of Benjamin Elliott via Sussex Co., DE Orphan's Court records of Mar 28 1877 (issued Apr 17 1877) where Benjamin petitioned the court to divide lands of Jacob Elliott that were held as dower by Jacob's wife (Benjamin's mother), Sally H. Elliott - Sally having died on Mar 2 1877. The record lists Jacob/Sally's eleven (11) children as Benjamin; Patsy H. Cordrey (wife of Spencer M. Cordrey); Elenor Melson (wife of John Melson, but she is dead leaving four children - Sally and three others unknown); Solomon M. Elliott; Lovey Hastings (wife of Winder Hastings, but she is dead leaving seven children - Julia A. Gordy, w/o John M. Gordy; Jacob Hastings, Irene Disharoon, Elijah Hastings, Sydney Hastings, Mary Hastings, and Sarah Hastings); Samuel Elliott; Julianna Workman (wife of John Workman); John Elliott; William G. Elliott; Mary Collins (wife of Joseph R. Collins); and Jacob Elliott. The record lays out how the lands are to be divided and states that Jacob Elliott had died intestate on Mar 20 1841. The lands were located just to the north of the MD/DE line and just to the east of the "road from Laurel to Salisbury" and surrounded by land to north and east by Winder Hastings and to the south by Benjamin Elliott. Jonathan Hearn owned the land to the west.

In the 1816/1818 Tax Assessment for Little Creek Hundred, Sussex Co., DE, Jacob Elliott is assessed for 96a of land with a logged dwelling, 2 horses, 1 heifer, 5 sheep, 1 cow/calf, 2 swine.

Jacob Elliott purchased land from Thomas Freeny on Mar 18 1819 for $2229. It was land including tracts "Friends Denial", "White Oak" and parts of "Parkers Mistake", "Unkles Advice" and "Collins Adventure". Beginning at a small marked hickory a small distance SE of plantation that Jacob Elliott now lives. It stands on a line that divides the States of Maryland and Delaware and goes with four lines of "White Oak as N9W 155 1/2 perches to small ugly looking black gum, S79.5W 9 perches to marked sassafras, W 34.5 perches to large marked white oak, N75W 106 perches to county road leading from Laurel to Salisbury, S42W 20 perches with old county road and with boundary with Elijah Hastings to marked Spanish oak, N88.75W 51 1/2 perches with Elijah Hastings' line of marked trees to a dead and fallen red oak, now a pine knot post marking corner of "Friends Denial". S39W 67 1/2 perches to small marked pine at side of old field marking corner of "Neglect". S12W 55 1/2 perches to line of "Unkles Advice" and going with lines of said tract N69.25W 13 perches to corner of "UA", S33W 24 perches running across corner of said tract, S2W 16 perches to line of "UA", S76E 64 perches with line of "UA" to line of "Addition to Collins Adventure", S 26 perches with line of "ACA" to "Collins Adventure" to the state line, the S88E 334 perches with state line to beginning containing 321 1/2 acres. (SxLR-AN36:150) (COMPILER'S NOTE: this land includes most of all of modern Delmar, DE and centrally straddles US13 running about 1/2 mile from there towards Delmar and 1/4 mile from there to the east.)

Jacob Elliott, with William Gordy, were witnesses to the will of Joshua Freeny written May 3 1822 and proven in Worcester County, MD on Oct 27 1828. (WoW-1822/33:348)

An inventory of Jacob Elliott's personal estate was filed in Sussex Co., DE on Aug 11 1841 by his sons Benjamin and John Elliott with the former as administrator. Two different administrative accounts were filed in March and Apr 1842, respectively, and distribution was made on Apr 26 1842 for the amount of $27.48 to each of his 11 children and $151.19 to his widow Sally H. Elliott.
