It was 4 undivided 5th parts of a tract of land with the appurtenances which descended to the said grantors by the death of a certain Southy Milliner their relation, lying and being in the Parish and County of Accomack and bounded as follows by the lands of Selby Simpsons heirs on the North, and by the lands of John Moore on the East, by the lands of John A. Bundick on the South and by the County road on the West containing in the whole 28 acres. (NOTE: Smith Milliner, Rachel Guy and Ann Melson were siblings of Lancy Melson dec'd & Southy Milliner dec'd. Rosey Melson, Middleton Melson & John Melson were the children of Lancy Melson dec'd.)

He made a will on 21 June 1819 at Accomack Co, VA. He was shown as Smith Milliner of St. George Parish. Wife Nancy Milliner & friend William Bagwell Extrs. To wife Nancy Milliner my plantation whereon I now live for the term of 4 years ... & ... To son Thomas Milliner ... To son Smith Milliner at the end of the 4 year term of my wife, the plantation whereon I now live & he to pay the mortgage held by the heirs of John Dix dec'd. If he defaults on the mortgage, then the plantation to be sold to pay the mortgage & the remaining to my 5 sons Smith, James, John, Southey & Thomas Milliner & 2 daughters Tabitha & Ann Maria Milliner, one full share each. To daughters Catharine Drummond, Susey Hart & Polly Milliner, ½ share each. To daughter Ann Maria Milliner ... My Negro man Jingo to be free the Christmas following my death. Witt: William Bagwell, Samuel Teackle & Levin S. Phillips. Smith died before 26 July 1819 at Accomack Co, VA. It was on this date that his will was probated. Isaiah Bagwell & George P. Bagwell securities.

It was on this date that it was recorded that Smith, John, Southy, Thomas, Tabitha and Anna Maria Milliner and Susanna Hurst, wife of Thomas Hurst, Polly Carey, wife of Samuel S. Carey, Nancy Milliner, devisee of James Milliner, Richard, William, James, Henry Catherine and Tabitha Drummond, William Dunton and John Dunton are heirs at law of Robert Milliner dec'd, formerly Lieut. in the Virginia State Navy in the Rev. War. The said Smith, John, Southy, Thomas, Tabitha and Anna Maria Milliner, James Milliner, Polly Carey, Susanna Hurst being children of Smith Milliner dec'd, who was the eldest brother of the said Robert Milliner dec'd, who died before 1 Jan 1787, and the said Richard, William, James, Henry, Catharine and Tabitha Drummond being the children of Catherine Drummond dec'd, daughter of said Smith Milliner dec'd, and the said William Dunton and John Dunton being the children of Elizabeth Dunton dec'd, who was a daughter of said Smith Milliner dec'd.
